Terms of Service

Welcome to Foos App. These Terms of Service ("Terms") govern your access to and use of the Foos App mobile application, website at foos-app.com, and all related services (collectively, the "Service") operated by FoosApp ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent that you meet these requirements.

2. Your Account

You are responsible for maintaining the security of your account and for all activity that occurs under it. You agree to provide accurate information during registration and to keep your account information current. We authenticate accounts via phone number verification and may suspend accounts that use fraudulent or misleading information.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Harass, bully, threaten, or intimidate other users
• Post content that is defamatory, obscene, hateful, or discriminatory
• Impersonate another person or misrepresent your affiliation with any entity
• Upload viruses, malware, or any harmful code
• Attempt to gain unauthorized access to the Service or other users' accounts
• Scrape, crawl, or use automated means to access the Service without our permission
• Interfere with the proper operation of the Service
• Use the Service to spam or send unsolicited messages

4. User Content

You retain ownership of content you post, upload, or share through the Service ("User Content"), including posts, photos, comments, and messages. By posting User Content, you grant FoosApp a worldwide, non-exclusive, royalty-free, transferable license to use, display, reproduce, modify, and distribute your User Content in connection with operating and promoting the Service.

You represent that you have all necessary rights to post your User Content and that it does not infringe on the rights of any third party. We may remove or disable User Content at our discretion, including content that violates these Terms or our community standards.

5. Tournaments & Competition

The Service provides tools for organizing and participating in foosball tournaments. FoosApp facilitates tournament management (brackets, scoring, standings) but is not responsible for the conduct of any tournament, the accuracy of results entered by tournament administrators, or any disputes between players or organizers. Tournament directors are solely responsible for their events.

6. Messaging & Communications

The Service allows you to send direct messages to other users. You are solely responsible for the content of your messages. We may monitor messaging to enforce our community standards and prevent abuse, but we do not guarantee real-time moderation. By using the Service, you consent to receiving push notifications, in-app notifications, and SMS messages related to your activity. You may adjust notification preferences in your settings at any time.

7. In-App Purchases & Subscriptions

Certain features or content may require a paid subscription or in-app purchase, processed through Apple's App Store or Google Play. All purchases are subject to the terms of the applicable app store. Subscription billing, renewals, and cancellations are managed through your app store account. FoosApp does not process payments directly. Refund requests should be directed to the applicable app store.

8. Clubs, Organizations & Events

Users may create or manage clubs, organizations, and events through the Service. Administrators of these entities are responsible for the content posted within them and for managing their members appropriately. FoosApp is not liable for actions taken by club or organization administrators.

9. Intellectual Property

The Service, including its design, features, software, logos, and branding, is owned by FoosApp and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent. "Foos App" and the Foos App logo are trademarks of FoosApp.

10. Third-Party Services

The Service may integrate with or link to third-party services, including but not limited to video streaming platforms, payment processors, map services, and analytics providers. Your use of such third-party services is governed by their respective terms and privacy policies. FoosApp is not responsible for the content, privacy practices, or availability of third-party services.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to our collection and use of data as described in our Privacy Policy.

12. Moderation & Enforcement

We reserve the right to investigate and take action against violations of these Terms, including removing content, issuing warnings, temporarily suspending, or permanently banning accounts. We may also report illegal activity to law enforcement. Moderation decisions are made at our sole discretion.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOOSAPP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

15. Indemnification

You agree to indemnify, defend, and hold harmless FoosApp and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.

16. Termination

We may suspend or terminate your account at any time for any reason, including violation of these Terms. You may delete your account at any time through the app settings. Upon termination, your right to use the Service ceases immediately, but provisions that by their nature should survive (including Sections 4, 13, 14, 15, and 17) will remain in effect.

17. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction. You agree to resolve disputes on an individual basis and waive any right to participate in a class action.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by other reasonable means. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
